Required LGBTQ+ Training for Skilled Nursing Facilities

Starting January 1, 2018 regulation 22 C.C.R. § 72517 Staff Development requires that each skilled nursing facility regulated by the California Department of Public Health provide bi-annual training on working with LGBTQ+ people.

Who is mandated to take the training?

All registered nurses, licensed vocational nurses, certified nurse assistants, and medical directors.

By when must facilities be in compliance?

August 1, 2018, and ongoing beyond that date.

New York Code of Regulations

Required for

Starting December 23rd, 2022  regulation S2534A requires home health aides, personal care aides, personal care staff, and certified nurse’s aides to receive training in working with patients of diverse sexual orientations and gender identities and expressions.

Who is mandated to take the training?

All home health aides, personal care aides, personal care staff, and certified nurse’s aides.

New York Senate Bill S1783A

Required for

Starting 11/10/2023 Bill S1783A, also known as the New York State Long-Term Care LGBTQ+ Bill of Rights establishes certain requirements concerning rights of lesbian, gay, bisexual, transgender undesignated/non-binary, questioning, gueer, intersex, and HIV-positive residents of long-term care facilities.

Who is mandated to take the training?

The bill requires each long-term care facility to ensure that the administrators receive training on the Bill of Rights. Staff members are mandated to receive cultural competency training within six months of hire and every two years on the needs and experiences of LGBTQ+ and HIV+ older adults.

How can we comply?

New Jersey Bill

Required for

Starting 3/3/2021 Bill  S2545 establishes certain requirements concerning rights of lesbian, gay, bisexual, transgender undesignated/non-binary, guestioning, gueer, intersex, and HIV-positive residents of long-term care facilities.

Who is mandated to take the training?

The bill requires each long-term care facility to ensure that the administrators and staff at the facility receive training, on at least a biennial basis, concerning care for GLTBTQI seniors and seniors living with HIV.

Along with the administrators and staff training, each facility is required to designate two employees, with one representing management and one representing direct care staff, who will receive in-person training within six months after the effective date of the bill, which employees will serve as points of contact at the facility concerning compliance with the provisions of the bill and will be responsible for developing the training plan for the facility.

One year from effective date of the bill.

Oregon Bill

Required for

Senate Bill 99 prohibits certain facilities that provide long term care from taking specified actions based in whole or in part on resident’s actual or perceived sexual orientation, gender identity, gender expression or human immunodeficiency virus status. Imposes new requirements on facilities that provide long term care, with respect to care of residents who are lesbian, gay, bisexual, transgender, queer, intersex, asexual, Two Spirit, nonbinary or other minority gender identity or sexual orientation or who have human
immunodeficiency virus. Permits Department of Human Services to impose civil penalties or take other administrative action for violation of provisions. Requires facility to ensure administrators and staff receive specified training. Requires entity that contracts with facility to provide services or supports to residents of facility to provide specified training to entity’s staff persons. Excuses from compliance with requirements any requirement that is
incompatible with professionally reasonable clinical judgment of management or staff of facility or with state or federal law.
Requires training required for facilities be completed by Long Term Care Ombudsman, deputy ombudsmen and designees of ombudsmen. Establishes LGBTQIA2S+ subcommittee of Governor’s Commission on Senior Services.
Specifies membership and duties of subcommittee.
